Holy shit! What the hell is up with these people?!

I wanted to believe that the organization is just fantastically inept at business, got in over the heads, and ultimately watched the whole thing fall out from under them over the course of 4-5 years. But with so many unpaid debts at all of their locations, I can't really believe that they were just stupid. Instead, this all feels really fraudy.

I feel bad for all their regular employees who are not only out of a job, but apparently many of their final paychecks either bounced or were withheld. They're also having trouble getting unemployment benefits because the company did not properly report their employment and, as a result, has not paid into the unemployment insurance that would fund those payments.

This whole thing really is a shit show.
The reality is that one of the corporate reps I saw there did have a bit of a shady feel to him so I wouldn't be surprised if some level of fraud was taking place.

To be fair, the Latitude 360 Wikipedia article, reads like it was written by someone with an axe to grind. But it definitely seems like a fair number of things at the company were nowhere near being on the up-and-up.

I don't remember if UI taxes are like this, but I know they were also in trouble with at least Indiana on sales taxes. The state will get that money. The owners of the company are jointly and severally liable to pay the state for any sales taxes they collected but did not remit. That is, corporate limited liability does not apply. Shit show indeed.

Unfortunately for the former employees, that doesn't apply to back wages. Sadly, wage debts aren't even that high up the priority list in a bankruptcy. If they haven't yet declared bankruptcy (somehow), there may be some hope if they sue quickly. Now, if indeed they were not properly reporting employment at all, that also means they may not have been remitting W-2 withholdings to the IRS. The IRS gets really mad when you do that. If there's any evidence of embezzlement, they'll have their way with the guilty parties eventually.

This is kind of what I was getting at. At this level of fuck up, I don't think they just screwed up so many things. They screwed up covering their tracks to get away with being a pack of shysters. These aren't shitty business people. These are shitty criminals.

At least that's my read on the situation.
